NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

I. OUR RESPONSIBILITIES REGARDING YOUR HEALTH INFORMATION

NELA Therapy is a group mental health practice that includes licensed clinicians, associate clinicians, and supervised pre-licensed clinicians. We create and maintain records of the care and services you receive. We are required by law to:

  • Maintain the privacy of your protected health information (“PHI”)

  • Provide you with this Notice of our legal duties and privacy practices

  • Follow the terms of the Notice currently in effect

We reserve the right to change this Notice. Any changes will apply to all PHI we maintain. The updated Notice will be available upon request, in our office, and on our website.

II. HOW WE MAY USE AND DISCLOSE YOUR PHI WITHOUT YOUR AUTHORIZATION

Treatment, Payment, and Health Care Operations

We may use and disclose your PHI for treatment, payment, and health care operations without your written authorization. This includes consultation among clinicians, supervision of associate clinicians, coordination of care, billing, and quality assurance activities.

Disclosures for treatment purposes are not subject to the minimum necessary standard.

Legal Proceedings

We may disclose PHI in response to a court or administrative order, subpoena, or other lawful process, consistent with applicable law. Whenever possible, we will seek to notify you or obtain appropriate protections before disclosing information.

III. USES AND DISCLOSURES REQUIRING YOUR WRITTEN AUTHORIZATION

Psychotherapy Notes

We maintain psychotherapy notes as defined by federal law. We will not use or disclose psychotherapy notes without your written authorization, except as permitted by law, including:

  • Use by your clinician for treatment

  • Use for supervision and training within the practice

  • Use in legal defense initiated by you

  • Health oversight activities

  • As required by law or to prevent serious harm

Marketing and Sale of PHI

We do not use or disclose your PHI for marketing purposes and we do not sell your PHI.

IV. SPECIAL PROTECTIONS FOR SUBSTANCE USE DISORDER RECORDS

If your PHI includes records relating to substance use disorder treatment, federal law (42 CFR Part 2) provides additional protections. Such records may not be re-disclosed without your written authorization or as otherwise permitted by law.

Federal law prohibits discrimination against individuals based on substance use disorder information.

V. OTHER PERMITTED USES AND DISCLOSURES

We may disclose PHI without authorization for:

  • Public health and safety reporting

  • Health oversight activities

  • Law enforcement purposes

  • Coroners or medical examiners

  • Workers’ compensation

  • Appointment reminders and care-related communications

VI. YOUR RIGHTS REGARDING YOUR PHI

You have the right to:

  • Request restrictions on certain uses and disclosures

  • Request confidential communications

  • Inspect and obtain copies of your PHI (excluding psychotherapy notes)

  • Request amendments to your PHI

  • Request an accounting of disclosures

  • Obtain a paper or electronic copy of this Notice

Requests must be submitted in writing. We will respond within the time frames required by law.

VII. COMPLAINTS

You may file a complaint if you believe your privacy rights have been violated. You may file a complaint with:

  • NELA Therapy, or

  • U.S. Department of Health and Human Services, Office for Civil Rights

You will not be retaliated against for filing a complaint.
